Legal basis of the whistleblower system

The EU Whistleblower Directive states that companies must set up a so-called whistleblower protection system so that anonymous reports of misconduct and breaches of rules can be submitted. To protect individuals, the whistleblower system must function so that complete anonymity is possible so that all kinds of wrongdoing in the company can be reported.

How does the reporting system work?

  1. Possible Misstep: A person in your company notices a possible misstep by another employee or a business partner.
  2. Anonymous report: The whistleblower reports anonymously/confidentially via the whistleblower system provided regarding their observation.
  3. Initial review: An initial review of the case is performed by the caseworker and us.
  4. Anonymous dialogue: We start an anonymous and secured dialogue with the whistleblower to talk about the case in more detail.
  5. Internal preliminary investigation: In the next step, an internal preliminary investigation and assessment of the situation begins.
  6. Measures: Based on the information, actions are taken and recommendations are made.
  7. Decision: Management makes a decision on how to handle the misconduct.
  8. Feedback: Feedback is provided to the anonymous whistleblower.
  9. Documentation: To close the case, it is documented in detail and reporting is created.

Which companies need a whistleblower system?

Companies with more than 50 employees are legally required to set up an internal whistleblower system for possible legal violations and to ensure formal process flows. In addition, business and contractual partners of your Group must also use a whistleblower system due to internal compliance requirements.
