Privacy information

A. General information on data protection

1. Scope and definitions

The data protection declaration includes the information in the sense of Art. 13 DSGVO about the data processing in the context of calling up and using our website “hwdata.de”. Insofar as we link to third-party sites, we have neither influence nor control over the linked content and the data protection provisions there. We recommend that you check the data protection statements on the linked websites to determine whether and to what extent personal data is collected, processed, used or made available to third parties there.

2. Responsibility

The responsible party for the processing of personal data via the website is HWData GmbH, Nordendstr. 64, 80801 Munich, Germany (hereinafter: “HWData”). You can reach us in all data protection-related questions at office@hwdata.de.

3. Place of data processing

All personal data that we collect and process via the website is stored on the servers of the company Raidboxes GmbH, Hafenstr. 32, 48153 Münster. The data location is Germany. The purpose of this data processing is the hosting of our web servers and databases as well as their data protection (backup).

B. General data processing when calling up our website

1. Logfiles

For technical reasons, HWData collects so-called access data when the website is called up and stores this in a log file (so-called log file). In addition to the IP address, the name of the website accessed by you, the file accessed, the date and time of access, the amount of data transferred and notification of successful access, the browser type provider are stored in the log file. We do not pass this data on to third parties. The log files are automatically deleted 7 days after collection. This collected data and information is therefore evaluated by us on the one hand statistically and on the other hand with the aim of increasing data protection and data security in our company, in order to ultimately ensure an optimal level of protection for the personal data we process (Art. 6 Para. 1 lit. f) DSGVO).

2. Plausible Analytics

In order to understand the use of our website and improve it, we use the web analytics tool Plausible Analytics. The provider of this tool is OÜ Plausible Insights, Västriku tn 2, Tartu 50403, located in Estonia. Plausible collects the following information for this purpose, among others: Date and time of your visit, title and URL of pages visited, incoming links, the country you are in and the user agent of your browser software. Plausible does not use or store “cookies” on your terminal device. All personal data (e.g. your IP address) is stored completely anonymously in the form of a so-called hash. A hash is an encryption of data that is not reversible, i.e. cannot be “decrypted”. In this way, we can analyze your visit without storing personal data in a form that would be readable by us, plausible or third parties. The legal basis is therefore Art. 6 para. 1 lit. f) DSGVO. To make transparent what data we collect, you can take a look at the full statistics of this page yourself: https://plausible.io/open-election-compass.com. Here you can find more information about Plausible and the data protection of this tool.

C. Other special data processing

1. Contact form

We offer a contact form on our website to answer questions of interested parties and users and to provide information about our services. We process the inquiries and information sent to us in this context only to process your inquiry and to contact you (Art. 6 para. 1 f) DSGVO). We store your data at the longest for the duration of a resulting business relationship with you (Art. 6 para. 1 b) DSGVO). If such a business and contractual relationship does not arise as a result of the request, we will delete your data no later than six (6) months after the last contact with you. The right to object to the processing beforehand or to request deletion remains unaffected, of course.

2. Appointment bookings

Visitors have the option to book meeting appointments directly with us via the integrated tool “Timify”. For this purpose, we only need your email address to manage the appointment and send corresponding reminders of the meeting (Art. 6 para. 1 f) DSGVO). The provider of this tool is TerminApp GmbH Balanstraße 73, 81541 Munich, with whom we have concluded a corresponding order processing agreement (Art. 28 DSGVO). The data collected in the course of booking an appointment is stored in Germany. Your data will be stored at the longest for the duration of a resulting business relationship with you (Art. 6 para. 1 b) DSGVO). If such a business and contractual relationship does not arise as a result of the appointment booking, we will delete your data no later than six (6) months after the appointment booking. The right to object to the processing beforehand or to demand deletion remains unaffected, of course.

3. Applications

We will gladly provide information on the type and scope of data processing in the context of an application upon receipt of your documents.
Ongoing mandate and client support
We will also be happy to provide you with information on the nature and scope of data processing in the course of our consultations and ongoing client support (e.g. in connection with our activities as external data protection officer) upon receipt of your inquiries.

4. LinkedIn

HWData uses the information service offered on LinkedIn via the technical platform and services of LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. We operate this website in order to interact with potential or existing customers, to exchange information with interested parties and users, or to advertise offers and services. We operate this website under joint responsibility (under data protection law).
HWData does not collect any data itself via its LinkedIn account. However, the data you enter on LinkedIn, in particular your username and the content published under your account, will be processed by us insofar as we may share your postings or comment on them, or also make postings from us that refer to your account. The data freely published and disseminated by you on LinkedIn is thus included by HWData in its offer. Beyond that, as the provider of our LinkedIn page, we do not collect or process any personal data from your use of our service. The page is used solely for information and communication purposes. The legal basis for data processing in our area of responsibility is Art. 6 para. 1 p. 1 f) DSGVO.
However, LinkedIn also processes data under its own responsibility. We have no influence on data that is processed by LinkedIn under its own responsibility in accordance with its own terms of use and data protection conditions. We would like to point out that further data (e.g. your usage and “surfing behavior”) may be collected and possibly transmitted to third parties by LinkedIn. In what way LinkedIn uses the data from the visit of LinkedIn pages for its own purposes, to what extent activities on the LinkedIn page are assigned to individual users, how long LinkedIn stores this data and whether data from a visit to the LinkedIn page is passed on to third parties, is not conclusively and clearly stated by LinkedIn and is not known to HWData. Further, LinkedIn states it may use the services of third parties (partner companies and external service providers) to assist it in providing its services (for example, maintenance, analysis, auditing, payment, fraud detection, marketing and development). For more information, please visit: https://www.linkedin.com/legal/privacy-policy. To the extent that we have personally identifiable information about you in connection with your use of LinkedIn, please direct your concerns to us. In addition, if you wish to assert any rights against LinkedIn, please contact LinkedIn. You have the right to request confirmation from us at any time as to whether we are processing personal data about you and the right to information about this personal data. In addition, you have the right to rectification, erasure and restriction of data processing, as well as the right to object to the processing of personal data at any time, or to withdraw consent to data processing at any time, or to request data transfer. In addition, you have the right to complain to a supervisory authority in the event of data protection violations. Please address all requests for information, revocations or objections to data processing by e-mail to office@hwdata.de.

E. Notes on the special right of objection

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out, inter alia, on the basis of Article 6(1)(e) or (f) DSGVO, in accordance with Article 21 DSGVO. We will stop processing your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves the purpose of asserting, exercising or defending legal claims. If you wish to exercise your right to object, simply send an e-mail to office@hwdata.de.
